Committee Charter

The purpose of this charter is to define the mission, authority, responsibilities, and membership for the Castleberry Point Condominium HOA’s (hereinafter referred to as the “HOA”) [Architectural Control and Beautification (ACC)] Committee. The charter also conveys commitment from and implied support by members of the HOA, the association’s board of directors, as well as the property managers with Heritage Property Management Services.  

Purpose 

 The committee members that serve on the Architectural Control and Beautification Committee (ACC) are volunteers and must often hold meetings to review pending requests and potential issues within the community related to the community's covenants for the common, residential and commercial areas. Recommendations will be made to the board for approval.

This will be achieved by meeting as often as necessary to complete the assigned responsibilities and carrying out plans through required actions to complete the annual goals and objectives. 

Scope of Authority

Ultimate authority for this committee lies with Castleberry Point HOA’s current board of directors. The committee has no expressed or implied power or authority.  Only recommendations will be made to the board of directors for approval of projects.  Exception: Approval of commercial elevations (e.g., signage, internal/external, canopy, etc.  and residence condo modification.

Membership

The committee shall have a minimum of 3 members and a maximum of 5 members with voting power. All voting members must be approved by the Board of Directors. Each voting member will serve a term of 2 years. The board may fill vacancies on the committee and may remove a member from the committee with cause only. Any community owner may participate in all meetings and assist with projects as a non-voting member of the committee. Non-voting members can be added or removed by the voting committee members at any time.

Members must be in good standing, with no delinquencies or open violations that resulted in a fine in the current calendar year. They must also be residential or commercial owners at Castleberry Point. Voting members cannot miss more than three consecutive ACC meetings annually, or they will lose their voting rights and be dropped to non-voting member status. All members, voting or non-voting, must participate significantly in a minimum of one project per quarter.

ACC committee members must review this Committee’s Code of Conduct and keep other members' personal contact information private and confidential.

The committee is closed to non-members of the committee, and the public.

Roles and Responsibilities 

The Architectural Control (ACC) and Beautification Committee is a standing committee within the Castleberry Point Condominium HOA, who reviews modifications that owners want to make to their homes to ensure they are complying. The ACC serves at the pleasure of the HOA board. The ACC (HOA standing committee) shall assist the board of directors in fulfilling its responsibilities related to:

The committee will report its activities to the board weekly or on an as needed basis via board approval communication tool (E.g., Trello, email).

Meetings

A majority of the ACC committee members shall constitute a quorum. The committee chair will keep a copy of the committee meeting minutes and forward a copy to the board secretary. The committee chair may invite any director, officer, staff member, expert or other advisor who is not a member of the committee to attend, but these individuals have no voting power for the committee recommendations.

ACC committee members commit to meeting at least once a week (Monday at 6:00PM) and commit to a term of at least two (2) years.

Revision

This charter may be reviewed and revised by the ACC as deemed necessary and approved by the board.
