Collections Policy
The association applies the following automatic schedule for delinquent accounts to all residential, live/work, and commercial units at Castleberry Point. As per our declaration, homeowners are responsible for all charges on their account, including, but not limited to, dues, water/sewer charges, violation fines, fees, late fines, and interest charges.
When an account reaches a 30+ day balance of $2,000 or more, the collections process begins, and all legal fees related to any collections activities will start to accrue against the account
First, a demand letter is sent to the unit owner after this threshold is reached
At any point in this process, the homeowner may pay off their full account balance, which will include all legal fees accrued so far
The unit owner has ten (10) days to either pay off the entire balance in AppFolio or reach an agreement with the board on a payment plan
If 10 days pass and the above conditions do not occur, a lien will be placed on the property
If the account balance reaches $10,000 or more, a collections action will take place (likely a small claims suit)
Once the balance reaches $25,000 or more, the association will begin foreclosing on the unit
If the account is not paid in full, the unit may be foreclosed on and sold to a new owner, likely within one (1) year
It is important to note that failing to pay your HOA charges, water/sewer bills, property taxes, or mortgage could ultimately result in the foreclosure of your unit. It is essential that you keep all of your balances in check.
